Accessories - Includes: wallpaper (murals, decals, papers, etc) preparation (gaps, abrasives, fillers, caulking guns, etc), application (brushes, rollers, trays, spray equipment, etc), clean up (drop sheets, hand cleaner, rolla cleana, graffiti remover, excluding solvents) safety (masks, respirators, gloves, etc), access (ladders, planks, etc), clothing (caps, t-shirts, shorts, etc), specialty (grout pens, can openers, etc).
Paint - Anything that has been or can be tinted including; sample pots, primers & undercoats, ceiling paint, wall paint, trim paint, exterior paint, texture paint, marine paint, automotive paint, aerosol cans, specialty paints, metal protection, woodcare oils and stains, sealers, paving paint and basically anything that comes in a can and can be applied to surfaces.
Solvents - Includes acid, acetone, brush & roller restorer, degreaser, kerosene, methylated spirits, mineral turpentine, paint stripper, shellite, toluene, wax and grease remover, white spirits and xylene etc.
Any time a Paint Club member purchases a tintable product, the colour is recorded against the Paint Club member’s account. This information is available both online and in-store. If you have any questions regarding this service, please call 1300 368 325 (press 3).
New Paint Club members are defaulted to receive the FULL amount of communications from Inspirations Paint. This means they will receive the monthly eNewsletter, they will know about special promotions, sales and other offers. We will also communicate to them from time to time about general housekeeping news such as stores changing address.
If members do not wish to receive the FULL communications, they can choose to select LIMITED communications in which they would only receive Project Notifications and critical store related communications such as change of address etc. They will not receive regular monthly emails or SMS about promos and sales.
If a customer wishes to unsubscribe from Paint Club, they are no longer entitled to receive the benefits of Paint Club (including discounts and access to Inspirations Paint's colour recording service.
1. Exclusion of implied terms
The buyer acknowledges that:
(a) Prior to execution of this agreement the buyer conducted a thorough examination of the goods; and
(b) No warranty, condition, description or representation in relation to the goods is given by the seller, expressly or impliedly by this agreement or outside this agreement;
(c) All warranties, conditions, guarantees and terms in relation to the state, quality or fitness of the goods and of every other kind whether expressed or implied by use, statute or otherwise are excluded;
Subject to any statutory rights (including under the Australian Consumer Law).
2. Qualified exclusion
The law implies terms, conditions, warranties or guarantees into contracts for the supply of goods and services and prohibits the exclusion, restriction or modification of certain terms, conditions, warranties or guarantees. Some Prescribed Terms permit a supplier to limit its liability for a breach of the prescribed terms. Except as provided by prescribed terms:
(a) The liability of the seller in respect of a breach of a Prescribed Term relating to the products or any part of the products is limited at the option of the seller to the replacement or repair of the products part thereof or payment of the cost of repairing or replacing the products or any part of the products;
(b) In these conditions the buyer does not have under any circumstances any cause of action against or right to claim or recover from the seller for, or in respect of, any loss or damage of any kind whatsoever, caused directly or indirectly by:
(i) Any defect in material or workmanship of, or any other defect whatsoever in, or unsuitability for, any purpose of the products or any part of the products; or
(ii) Any default or negligence on the part of the seller or of any employee, contractor or agent of the seller or of any person for whom the seller has legal responsibility relating to the supply of, or otherwise concerning products or any part of the products.
3. Exclusion of negligence
The seller is not liable to the buyer in contract or in tort arising out of, or in connection with, or relating to:
(a) The performance of the products or any breach of these conditions;
(b) Any fact, matter or thing relating to the products; or
(c) Any error (whether negligent or in breach of contract or not) in information supplied to the buyer or a user before or after the date of the purchaser's or user's use of the products,
Subject to any statutory obligations (including under the Australian Consumer Law).
4. Exclusion of representations and arrangements
These terms and conditions supersede and exclude all prior and other discussions, representations (contractual or otherwise) and arrangements relating to the supply of the products or any part of the products including, but without limiting the generality of the foregoing, those relating to the performance of the products or any part of the products or the results that ought to be expected from using the product.
(a) The buyer indemnifies on a continuing basis and on a full indemnity basis the seller from and against any liability, loss, expense or demand for or arising from any false, misleading, deceptive or misdescriptive representation or statement made by the buyer in respect of the products to any person. This indemnity survives termination of this agreement by either party for any reason.
(b) The seller indemnifies the buyer on a continuing basis on a full indemnity basis from and against any liability, loss, expense or demand for or arising from any false, misleading, deceptive or misdescriptive representation or statement made by the seller to the buyer for or in respect of the products.”
